Privacy Policy

This Privacy Policy describes how Ballfrog.com, LLC and its affiliated companies and partners (“Ballfrog”, “MTCS Developer”, “we”, or “us”) collect, use, and share information when you use our Services. The Services are the Ballfrog mobile application and Ballfrog-powered school applications, the companion websites we host for schools, our school administrative portal at ballfrogadmin.com, our sponsor portal, the share links and QR codes we generate for schools and users, our website at Ballfrog.com, and the SMS, email, and push notifications we send in connection with them. Ballfrog is a communications platform for school athletics and activities. We do not sell personal information, and we do not use the Services to serve targeted advertising. Information We Collect

Account information. You can browse a school’s public schedules, scores, and news without an account. To follow teams, post, or join chats, you create an account with your name and mobile phone number, which we verify by sending a one-time code by SMS. You may also provide an email address, a profile photo, and a preferred language. We do not collect passwords, and we do not ask for your date of birth.

Content you create. This includes posts, comments, reactions, photos and videos, poll and RSVP responses, and messages you send in chats, along with the time you created them. The Services use your device’s camera, microphone, or photo library only when you choose to capture or select media for a post, a profile picture, a team photo, or another upload.

Your activity and preferences. We record the schools and teams you follow, the chats you belong to, and your notification settings so we can deliver the content you asked for.

Device and log information. When you use the Services we receive technical information such as your IP address, device type and operating system, app version, push notification token, the pages or screens you visit, and crash and error reports. We use this information to operate and secure the Services and to diagnose problems. When you open a shared Ballfrog link or scan a Ballfrog QR code, we record the visit, including your IP address and browser or device type, so the school can see how its content is being shared. We do not request or collect your device’s precise location.

Information provided by schools. Schools that use Ballfrog provide the content that appears in their app and website, such as schedules, results, rosters, news, and staff and coach information. Rosters may include a player’s graduation year when the school supplies it. Schools may also create accounts for members of their community through the administrative portal and assign the account type. A school may also provide contact information for members of its community so that it can reach them through the Services. Information a school provides is controlled by the school and is handled as described under School and Student Information below.

Cookies and local storage. Ballfrog does not set cookies. Our apps and websites keep a small amount of information on your device using your browser’s or device’s local storage, such as your signed-in session and your preferences, and that information is not used to track you across other sites. Where a school embeds content from third-party services such as X (formerly Twitter) or Instagram, those services may set their own cookies under their own privacy policies. The Ballfrog website and mobile application do not respond to Do-Not-Track signals because we do not track users across third-party sites.

How We Use Information

We use the information described above to:

• provide the Services, including showing you the schools and teams you follow, delivering chats, and displaying your posts to your community;
• send the push and email notifications you have opted into, such as score updates, schedule changes, and messages from your school, and send SMS one-time codes when you sign in;
• verify your identity when you sign in and protect the Services against abuse and unauthorized access;
• translate content into your preferred language and generate text descriptions of images for users who rely on screen readers;
• respond to your support requests and communicate with you about the Services;
• understand how the Services are used, using de-identified and aggregated information, so we can improve them and fix problems.

We do not use your information to build advertising profiles, to serve targeted advertising, or for any purpose unrelated to operating the Services. Any sponsor content that appears in a school’s app is chosen by the school and is not targeted based on your personal information.

Who Can See Your Information

Content schools publish. Schedules, scores, news, photos, and other content a school publishes to its Ballfrog app or companion website is visible to anyone who uses that app or visits that website, and content on a companion website may be indexed by search engines. Schools decide what they publish.

Content you post. When you post, comment, or react, your name and profile photo appear alongside that content to the other members of the school or team community where you posted it. Schools control who can post in their app and may remove content.

Chats. Messages you send in a chat are visible to the members of that chat. In addition, a school’s administrators can view team chats within their own school, chat monitors designated by a school can view the group chats within that school, and Ballfrog personnel can access chats when necessary for support, safety, or moderation. There are no public chats.

We do not publish user profiles to search engines, offer public APIs to your account information, or provide your information to data brokers.

How We Share Information

Service providers. We use third-party providers to run the Services on our behalf, including cloud hosting, storage, and encrypted backups, SMS and push notification delivery, email delivery, machine translation, image-description generation, address lookup when a school enters an address, security and abuse prevention on our web forms, error and performance monitoring, and payment processing for school sponsorships. These providers receive only the information needed to perform their function, are bound by confidentiality obligations, and may not use it for their own purposes. A current list of the categories of providers we use is available on request.

Schools. A school can see the activity of members of its own community within its app, such as who follows its teams and the content they post there, so that it can manage its community.

Corporate affiliates. Our corporate affiliates may access information solely to operate, support, secure, and improve the Services under the same restrictions that apply to us. We do not share your information with affiliates for their own marketing.

Legal requirements and safety. We may disclose information when required by law, subpoena, or court order, or when we believe in good faith that disclosure is necessary to protect the safety of any person, to investigate fraud or abuse, or to protect the rights and property of Ballfrog, our schools, or our users.

Business transfers. If Ballfrog is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its business, information may be transferred to the successor as part of that transaction. Any successor will remain bound by this Privacy Policy, and School and Student Information will remain subject to the terms of the school’s agreement. We will notify affected schools before their information is transferred.

With your direction. We share information when you ask us to, for example when you choose to share a post or schedule outside the app.

School and Student Information

When a school uses Ballfrog, information the school provides or that relates to its students is controlled by the school. We act as a service provider to the school and use that information only to provide, maintain, secure, and support the Services for the school and its community, to follow the school’s instructions, to improve the Services using only de-identified and aggregated information, or as required by law. Where a school provides information protected by the Family Educational Rights and Privacy Act (FERPA), we act as a school official with a legitimate educational interest under the school’s direct control. Parents and schools can request access to, correction of, or deletion of a student’s personal information, and can ask us to stop further collection, by contacting the school or us at questions@ballfrog.com. Student information is retained only as long as necessary to provide the Services the school has requested, to satisfy the school’s instructions, or to meet legal requirements, after which it is securely deleted or de-identified.

Use By Children Under 13 Years of Age

Our Services are not directed to persons under 13, and no one under 13 may create an account or use the Services, including through a school-provided account. Schools may not provision Ballfrog accounts for students under 13. If you become aware that your child has provided us with personal information, please contact us at questions@ballfrog.com. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child’s account.

Your Choices

Notifications. You can turn push and email notifications on or off for each team you follow in the app’s settings. We use SMS only to send one-time sign-in codes, so there are no SMS notifications to manage. We may still send administrative messages about your account or the Services.

Access and correction. You can view and update your name, photo, contact details, and language preference in the app at any time.

Deleting a post or message. When you delete a post, comment, or chat message, it is hidden from other users immediately. The underlying record may be retained for safety, legal, or support purposes and is handled as described under Data Retention below.

Deleting your account. You can delete your account from the app’s settings or by submitting a request at ballfrog.com/account-deletion. When you do, your account is deactivated immediately: you are signed out, your profile is no longer visible, and you can no longer be reached through the Services. We then delete or de-identify the personal information associated with the account in the ordinary course, except where we must retain it to meet legal obligations, for security purposes, or to complete a request from your school. You can also ask us to delete your personal information at any time by contacting questions@ballfrog.com. Content you posted to a school’s community may remain visible at the school’s direction.

Data Retention

We keep your account information for as long as your account is active. Device and log information is kept for as long as we need it for security, troubleshooting, and aggregate reporting to schools. Information provided by schools, and chat messages within a school’s community, are kept for the period set by the school’s instructions and our agreement with the school, which may reflect the school’s own records-retention obligations, and are then deleted or de-identified. Copies may persist in encrypted backups for a limited time after deletion.

Security

We protect information with administrative, technical, and physical safeguards, including encryption of data in transit over public networks and at rest in our databases and storage, restricting access to authorized employees, contractors, and agents who need it to operate the Services, and regular review of our practices. Our primary systems are hosted on Amazon Web Services in the United States, and encrypted backups are also kept with a second cloud storage provider, also in the United States. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we learn of a breach affecting your personal information, we will notify affected schools and users as required by applicable law. For Users in California

California Civil Code Section 1798.83 permits California residents to request information about disclosure of their personal information to third parties for those parties’ direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes. For Users Outside the United States

The Services are hosted in the United States and are intended for use in the United States. If you access the Services from outside the United States, your information will be transferred to and processed in the United States and in the locations where our service providers operate, which may not have the same data protection laws as your location. By using the Services you consent to that transfer and processing in accordance with this Privacy Policy and our Terms of Service.

Governing Law

This Privacy Policy is governed by the laws of the State of Tennessee, excluding conflicts of law principles. Any legal actions against Ballfrog arising out of or related to the Services must be commenced in the state or federal courts located in Davidson County, Tennessee. Disclaimers of warranty and limitations of liability are set out in our Terms of Service.

Changes to this Policy

We may revise this Privacy Policy from time to time. The most current version will always be at ballfrog.com/privacy-policy, and revisions are effective when posted there. By continuing to use the Services after a revision is posted, you agree to the revised Privacy Policy.
